CHRISTIAN NEWS.- A father has filed a lawsuit in New York to annul laws that prohibit incestuous practice in order to marry his adult son.
The lawsuit was filed in Manhattan federal court on April 1 and asks a judge to declare incest laws “unconstitutional” so that a father can marry his offspring at a ceremony in New York City, according to documents obtained by the New York Post .
“Through the enduring bond of marriage, two people, regardless of the relationship they may have with each other, can find a greater level of expression, intimacy and spirituality,” the father argued in the presentation.
The lawsuit has kept the identities of both parties vague, with the genders, ages, addresses and names of both the father and the adult son unknown.
disgusting and anonymous
The father wrote in court documents that he chose to remain anonymous because his request is “an action that a large segment of society finds repugnant.” from the moral, social and biological point of view”.
However, the filing confirms that “the proposed spouses are adults. The proposed spouses are biological father and child”, and reveals that “the proposed spouses cannot procreate together”.
The documents describe the father and son as a “PAACNP (Parent and Adult Child Non-Procreating)” couple and state that it would “diminish their humanity” if they could not legally marry.
The father has not yet proposed to his offspring, explaining that he has not done so as he feels it would cause “emotional harm.”if they were engaged but not legally allowed to marry.
When applying for a New York City marriage license, both spouses must disclose their parents’ name and country of birth, and declare that there are no legal impediments to the marriage.
felony incest
Incest is currently a third degree felony in the state of New York, who can be punished with up to four years in prison for each offender.
Incestuous marriages performed in the state are also not recognized by New York, and spouses face up to six months in prison and a fine for performing a ceremony.
The couple has yet to apply for a marriage license, but Manhattan marriage and family law attorney Eric Wrubel told the post that the lawsuit “will never fly.”
Incest between consenting adults is illegal in all US states except New Jersey and Rhode Island, but marriage is prohibited in those states along with the rest of the country.
